By purchasing items from this website, you agree to the terms set out below. Please read them carefully before making a purchase.
1. Entering Into a Contract
When you place an order on www.bettykayton.art, you are making an offer to buy an item in accordance with these terms. A contract is only formed when you receive an order confirmation email. Until then, I reserve the right to decline your order. I reserve the right to update these terms at any time; the version in effect at the time of your purchase will apply.
2. How to Buy Items
Browse available artworks, add them to your cart, and follow the checkout process providing accurate contact and payment details. All prices are in USD and include applicable taxes. Shipping is free for all US orders. International shipping costs will be added at checkout — please use the Contact page to request a quote before purchasing. Payment must be made in full before items are shipped.
Custom orders require a non-refundable 30% deposit upfront. The balance is payable once the order is completed. Custom orders will not be shipped until payment is received in full. Once your order is placed you will receive a confirmation email.
3. Cancellation and Returns
3.1 Cancellations
You may cancel your order within 24 hours of purchase by contacting me at bettykayton@gmail.com. After this period, cancellation may not be possible if your order has already been prepared or shipped.
3.2 Returns
Due to the nature of original and custom-made artwork, returns are generally not accepted unless the item is damaged in transit or significantly different from its description. If your item arrives damaged, please contact me within 7 days of delivery with photographs of the packaging and item. Refunds will only be processed once the item is returned. For damaged items, provide proof of shipping costs to be eligible for a shipping refund.
3.3 Return Shipping
Where a return is agreed upon (excluding damaged items under 3.2), you are responsible for safely packaging the item and covering return shipping costs.
4. Delivery and Shipping
Items will be shipped to the address provided at checkout. Please ensure your details are accurate — I cannot be held responsible for items lost due to incorrect information. Delivery times vary by location; estimated times will be provided at checkout but cannot be guaranteed. International buyers are responsible for any customs duties, taxes, or import fees.
5. Intellectual Property
All content on this website — including images of artworks, text, designs, and logos — is the property of Betty Kayton Art and is protected by copyright law. Purchasing an artwork does not transfer copyright or reproduction rights. The buyer owns only the physical item, not the right to reproduce, distribute, or create derivative works. No content from this site may be copied, reproduced, or used commercially without written permission.
6. Privacy & Data Use
Information collected during the ordering process (name, email, shipping address, payment details) is used solely to process and deliver your order. I do not sell or share your personal information with third parties, except as required to complete transactions (e.g. payment processors, shipping companies). Payment details are handled securely through trusted third-party providers and are never stored by me directly.
